Terms of Service

These terms govern your use of Graden. By creating an account or using the service you agree to them. If you don't, please don't use the service.

1. Who we are

Graden is operated by Graden Ltd, a company registered in England and Wales. References to "we", "us" or "Graden" mean Graden Ltd. References to "you" mean the organisation using the service and the individual users acting on its behalf.

2. Accounts

You need an account to use the service. You're responsible for keeping login credentials secure and for everything done under your account. Tell us promptly if you suspect unauthorised access at hello@gradenhq.com.

Each company should have one Graden account. Invited teammates count as users of that account, not separate customers. You must be 18 or over to sign up.

3. What the service does

Graden helps your team send take-home assessments to candidates, collect their deliverables, and review them with the help of an AI that scores against your grading criteria and drafts talking points for the follow-up interview.

4. AI review is advisory, not a hiring decision

The scores and talking points produced by Graden's AI are inputs to your hiring judgement, not verdicts. You remain solely responsible for hiring decisions and for any communication with candidates. We don't make hiring decisions and we can't guarantee that AI output is free of error or bias. Treat it as a starting point for a human review, not a substitute for one.

5. Acceptable use

You agree not to:

  • Use the service to break the law, infringe rights, or harm others
  • Upload content you don't have permission to share
  • Probe, scan or test the security of the service without our written consent
  • Reverse engineer the service or scrape it at scale
  • Use the service to send unsolicited messages
  • Resell or sublicense the service

6. Your data

Content you and your candidates submit through the service ("Customer Data") belongs to you. We process it on your behalf to provide the service, as described in our Privacy Policy. We don't sell it, and we don't use it to train third-party AI models.

You confirm that you have the right to share Customer Data with us, including any candidate information you upload or invite into the platform, and that you will give candidates appropriate notice of how their data will be processed.

7. Payment

Paid plans are billed monthly or annually through Stripe. Fees are payable in advance and are not refundable except where required by law. You can change or cancel your plan at any time through the billing portal; changes take effect at the end of the current billing period. If a payment fails we'll retry it; if it keeps failing we may suspend or downgrade your account.

8. Intellectual property

We own the service, including the platform, AI prompts, marketing site, and any improvements. Customer Data is yours. Library challenges and grading guides we provide are licensed to you for use within the service. Don't copy them out for use elsewhere.

9. Service availability

We work to keep Graden available and reliable but don't guarantee uninterrupted service. We may make changes to the service over time. We'll give reasonable notice of material changes that affect you.

10. Warranties and liability

The service is provided "as is" and "as available" without warranties of any kind, express or implied, except as required by law. To the maximum extent permitted by law, our total liability under these terms in any 12-month period is limited to the fees you paid us during that period. We are not liable for loss of profits, loss of data, or indirect or consequential loss.

Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by law.

11. Termination

You can cancel your account at any time. We can suspend or terminate accounts that breach these terms or that are used in a way that exposes us to legal or security risk. On termination, your access to the service ends and we'll delete Customer Data within a reasonable period unless we're required to retain it by law.

12. Governing law

These terms are governed by the laws of England and Wales. Disputes will be heard exclusively in the courts of England and Wales.

13. Changes to these terms

We may update these terms from time to time. If a change materially affects your rights we'll notify you by email and give you an opportunity to review the new version before it takes effect. Continued use of the service after a change means you accept the new terms.
